Terms of Service for Creonix

1. Agreement to Terms

By accessing or using the Creonix service located at https://app.creonix.pro (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of the Terms, you may not access the Service.

These Terms apply to all visitors, users, and others who access or use the Service.

2. Service Description

Creonix is a SaaS platform that allows users to connect their Instagram business accounts via OAuth to schedule and publish organic video content (reels and stories) and access analytics (e.g., reach, follower growth, post engagement). The Service interacts with the Instagram Graph API to authenticate accounts, publish content, and retrieve analytics, in compliance with Meta’s Platform Terms and Developer Policies.

3. User Accounts and Responsibilities

To use the core features of the Service, you must connect your Instagram business account using the OAuth process provided by Meta (Instagram). You are responsible for:

• Maintaining the security of your Instagram account and all activities that occur under it.
• Providing accurate information during the OAuth connection process and updating it if it changes.
• Granting Creonix permission to access your Instagram account as necessary to provide the Service, including publishing video content and retrieving analytics, subject to the permissions granted during the OAuth flow.

You confirm that you have the authority to connect the Instagram account and that your use of the Service complies with Instagram’s Community Guidelines and Platform Policy.

4. User Conduct

You agree not to use the Service:

• In any way that violates Instagram’s Community Guidelines, Platform Policy, or any applicable local, national, or international law or regulation.
• To upload or publish content that is harmful, fraudulent, deceptive, threatening, harassing, defamatory, obscene, or otherwise objectionable.
• To transmit any advertising or promotional material not permitted by Instagram, including "spam" or unsolicited promotions.
• To impersonate Creonix, a Creonix employee, another user, or any other person or entity.
• To interfere with or disrupt the integrity or performance of the Service, its servers, or any data contained therein.
• To attempt to gain unauthorized access to the Service, its servers, or any related systems.

We reserve the right to suspend or permanently ban your account, without prior notice, if we detect any violations of these Terms or Instagram’s policies, with no option for reinstatement.

5. Content and Usage Policies

You are solely responsible for the video content (reels and stories, up to 30 MB) you upload and publish through the Service. By uploading content, you confirm that it complies with Instagram’s Community Guidelines and Platform Policy, and that you have all necessary rights and permissions to publish it. Creonix is not responsible for content that violates these rules or any actions taken by Instagram, such as rejections, muting, or account suspensions.

The Service supports only video content. We process uploaded media by compressing it to H.264 format to meet Instagram’s requirements, preserving the original aspect ratio. Publishing or scheduling may take a few minutes, and you can monitor the status in the Media List.

6. Intellectual Property

The Service, its original content (excluding user-uploaded content or data retrieved via the Instagram API), features, and functionality are the exclusive property of Creonix and its licensors. The Service is protected by copyright, trademark, and other laws of France and foreign jurisdictions. Our trademarks and trade dress may not be used without prior written consent from Creonix.

You retain ownership of the content you upload to the Service. By uploading content, you grant Creonix a non-exclusive, worldwide, royalty-free license to process, store, and publish that content through the Instagram API solely to provide the Service.

7. Disclaimers

The Service is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. Creonix does not guarantee that:

• The Service will meet your requirements or be available uninterrupted, secure, or error-free.
• Analytics data (e.g., reach, follower growth) will be accurate or complete, as it depends on Instagram API data.
• Defects or errors will be corrected, or the Service will be free of viruses or harmful components.

Creonix is not responsible for actions taken by Instagram, such as content rejections or account suspensions, due to violations of Instagram’s policies.

8. Limitation of Liability

To the maximum extent permitted by law, Creonix, its directors, employees, partners, agents, suppliers, or affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your use of or inability to use the Service.
• Any conduct or content of third parties on the Service, including Instagram.
• Unauthorized access, use, or alteration of your content or data.
• Any actions taken by Instagram, such as content rejections or account suspensions.

This limitation applies regardless of the legal theory (warranty, contract, tort, or otherwise) and even if we were informed of the possibility of such damages.

9. Indemnification

You agree to defend, indemnify, and hold harmless Creonix, its affiliates, licensors, and their respective employees, contractors, agents, officers, and directors from any claims, damages, losses, liabilities, costs, or expenses (including attorney’s fees) arising from:

• Your use of the Service or any content you upload or publish.
• Your violation of these Terms or Instagram’s policies.
• Your violation of any rights of a third party, including intellectual property rights.

10. Termination

We may suspend or terminate your access to the Service, without prior notice, for any reason, including if you violate these Terms, Instagram’s policies, or applicable laws. Upon termination, your right to use the Service will cease immediately.

To terminate your account, you may do so through the Account Settings by selecting "Delete Account," which will also delete associated data as outlined in our Privacy Policy. Provisions of these Terms that should survive termination (e.g., ownership, disclaimers, indemnity, limitation of liability) will remain in effect.

11. Governing Law

These Terms shall be governed by the laws of France, as Creonix operates under a French company. Our failure to enforce any right or provision of these Terms does not constitute a waiver of those rights. If any provision is found invalid or unenforceable, the remaining provisions will remain in effect.

12. Changes to Terms

We may modify these Terms at any time. Material changes will be communicated with at least 30 days’ notice before they take effect, via email or a notice on the Service. Non-material changes will take effect immediately upon posting. By continuing to use the Service after changes, you agree to the revised Terms. If you do not agree, you must stop using the Service.
